The 17 phases
Before You File: Get Organized and Define Your Goal
2 to 6 weeks of prep before filing, or longer if you are still gathering records.
Which Court and Which State: Jurisdiction and UCCJEA Basics
Resolve jurisdiction before filing. If it is contested, it can add weeks to months.
Establishing Paternity If You Were Not Married
Weeks to a few months if DNA testing is needed. Do this before any custody filing.
Preparing and Filing Your First Motion or Complaint
A few days to draft if you are organized. Filing is same day at the clerk.
Filing Fees and Fee Waivers
The court usually rules on a waiver within days to a couple of weeks.
Service of Process
Usually a few days to two weeks. Longer if the other parent is hiding.
The Other Party's Response
14 to 28 days for their response, then your time to answer any counter.
Temporary and Ex Parte Orders
Temporary orders can issue within weeks of filing and last months until final.
Mediation and Settlement Conferences
Often one or two sessions over a few weeks.
Guardian ad Litem, Custody Evaluation, and Friend of the Court
Evaluations can take one to three months. Schedule interviews and visits promptly.
Discovery
Several weeks to a few months, set by court scheduling orders.
Pre-Hearing Prep and Exhibits
One to three weeks of focused prep before the hearing.
The Hearing or Trial
One hearing can last an hour to a full day. The court may continue over multiple dates.
The Order and What It Actually Means
The order is usually issued within days to weeks after the hearing.
Enforcement and Contempt
An enforcement hearing is usually set within weeks to a couple of months of filing.
Modification Later
Modification cases can take several months. Build your record before filing.
Appeals
Appeals can take many months to over a year. The filing deadline is short, often 14 to 30 days.
